i agree w/ both of you like thats so messed up. Basically you shouldn’t fight back and instead ask for help or report it to the police like??? what if theres no one around to help you, even the police is so hard to trust when it comes to assault cases
it’s different, if person A assaults person B, and person B responds (amount of force allowed is different between jurisdictions), that is self defense and allowed. if person C responds in an attempt to prevent an assault that is also ok. if person B/C responds in excess or retaliation (so if person A stopped or in a disproportionate amount) or that is not allowed. i assume its because harassment ≠ physical assault, so physical response is disproportionate.
rape ≠ harassment btw, that necessarily includes physical assault as an additional charge so attacking back physically is allowed
correct me if im wrong in this one, like in this case, that ex wasnt doing anything and was just like standing there when Garam did the flying punch thing. I think in this scenario the ex could charge him with physical assault (but im not entirely familiar with skorean law so im not sure if he could really do that). Jaehyuk thou, when he was hit by that bottle, could fight back i think w/o any legal consequences like that should be self defense
ok correct me if im wrong but this reminds me of JP law when it comes to assault. Like for example when u were sexually harassed, u cannot physically fight back or else u’ll be charged with physical assault. It fvkng sucks
