I really do not think it is rape. 'But she's not aware/ asleep/unconscious etc'. Yes, i know that him doing that while she is sleeping is quite a concern for you but really, honestly speaking, have you never done that to your lover before? Much more that they are husband and wife and it is normal for you them to seek each other for sexual pleasures. I would however be verrrry concerned if the moment she woke up, or is aware of what he was doing, starts pushing him away and stops his advances. Since you can say no to any sexual advances even if it is your spouse. But she did not. So yes, consent was given albeit a little late. So no, i don't think he raped her. And if she did in the end not concent to it and is traumatized with what he did, then it would really be a huge concern and i hope she would leave his ass or sue him. but i really don't think that's what happened so for me it wasn't rape.
