Short answer: no Long answer: no the fuck they can't. A few characteristics of being drunk are clouded perception, reduction in critical thinking ability, loss of cognition etc. A person in such a state can't be trusted to make proper decisions, especially ones as important as consenting to sex (which is a deeply personal act).
