Technically they weren’t together the first few times the seme touched him. And you cannot consent to sex if you’re drunk. It also depends on if the person is okay and is competent enough to even allow their partner to do it. So actually it was rape. Just for reference here in my country a couple of years ago there was a big scandal because some guys raped a girl and record it, the girl was so scare and intoxicated (drugs and alcohol) that didn't say no, screamed or barely moved during the crime but it was still rape, she wasn't mentally able to do anything and is a sad story that repites every year, big no if someone is drunk
