As i said in my comment. We dont know how drunk Chiwoo is. But that doesnt really matter because even if he was super drunk, it doesnt seem Hwan was trying to take advantage of that.

I literally wrote that it seems likely that even if Chiwoo was highly intoxicated, Hwan probably was not aware of it / Hwan drank as well and he is half awake.
And its possible we never knew about it because chiwoo thought it was a dream all along.
We have no way to tell how intoxicsted both are yet.
And that's why i made it clear in my comment that i "believe" that Chiwoo isnt too drunk and Hwan is probably drunk as well.

remember that we’re reading things from their POV. we’ve been seeing things from chiwoo’s pov from the beginning so if he remembered this then we would have known this happened ages ago.

Just because one person is drunk doesnt automatically make it rape...
First of all, Chiwoo got drunk by himself
Second, all the alcohol did was give Chiwoo the confidence and the confusion (he believes its a dream) to do the first move and go with the flow for the rest
He understand whats going on and didn't give any signs that he was against it (we even have access to his thoughts)
Third, it seems very likely that Hwan doesnt even consider Chiwoo might be too drunk to give a proper consent. Because he himself is half asleep and he drank as well.
I believe rape should be called when someone is forcefully or mentally (blackmail / manipulation / intentionally taking advantage of someone who is not in a proper mindset to be able to refuse / fear /...) forcing themselves on someone.
We dont know to what extent Chiwoo is drunk, but I highly doubt he is at a point where rape should be used. And even if it turns out he was dead ass drunk, i believe Hwan isnt trying to take advantage of it.
Chiwoo didn't say anything, aka he didnt ask for it or agreed to it verbally. But he initiated a kiss and didn't give any sign that he wanted to stop. Also, just because you asked at the begining, doesnt mean you have consent for the whole thing. Yet most people arent verbally asking if their partner want to keep going every 5 seconds. Because its common sense that the other person will do something (verbally or physically) if they dont want to do it anymore.
Therefore, after being kissed by Chiwoo, Hwan started to go further, and considered Chiwoo's going with the flow as consent.
