not all yaoi has sex scenes. yaoi is just the genre of boy love, its not always sex.

Yeah, but a good portion of them will have sex scenes which is why they are rarely labeled as smut as well as they should be
I think that genre you described are closer to shounen ai rather than yaoi though...
Yaoi is explicit bl, so if it goes beyond 1st base it's yaoi. In this case, they didn't have penetration but they did have that lovemaking scene at the end.
Shounen ai is bl but more innocent, so usually not going past a kiss or if there's a rare sex scene it's usually more toned down and glossed over.
