But isn't dan coherent? I can be wrong but that's how it works right? that if either one is coherent after drinking and then continues sexual activity with the incoherent one then it's non con. Funny how the consensual looking sex scene is still non con because even though Dan gave his consent, jaekyung is drunk out of his damn mind lol.
