It's not incest. It never went to sex. They're not half brothers and it was never stated that they were. Like the relatives said he was a product of one of the customers. Since he only started taking customers after he left the seme's dad, it means both the kids(uke and seme) were born awhile after their individual partners broke up.
Let's not forget 1)it was never stated that they were half-brothers. 2) the father wanted to start a family with the uke's mother, indicating they both didn't have children at the time. So he couldn't have gotten his actual wife pregnant yet (because the wife needs to be pregnant or he already has a child with the wife but contradicts with the fact that he said he wanted to start a family with uke's mother) since both the uke and seme were of the same age.
Right? This is pretty sweet for an omegaverse. It had its dark moments, but still.
But it's not incest though, the dad had a wife remember, he didn't love her but he had a wife and had a children with her, and Tsubaki went on with his own life and had his own child. THEY ARE NOT RELATED.
