What rule?
(Uh oh, someone forgot (its okay, I only remember because rules)) The first 5 episodes, Jae, explains the conditions when it comes to sleeping with him. One of them being sober and he doesn't want the person to forget or pass out.
The only other time the rules were broken unintentionally were when he didn't know Dan was drugged and when he himself got tipsy. ╮(￣▽￣)╭
Not many remember those rules since it's very early on in the story ヾ(❀╹◡╹)ﾉ~

For Jae to give in like this is even concerning the guy himself (⊙…⊙ ).
Also, I do like how even he doesn't want to go back to his own place as well as he hasn't completed his goal as well as Dan's request (⌒▽⌒).
The pause when Dan asked if Jae was worried about him was the moment Jae heard his "thoughts" out loud but didn't know how to answer even though it was yes. I sense he will have that question haunt him in the future as he lays there motionless and wonders how come he didn't answer the question. ╮(￣▽￣)╭.
I didn't really read the sex part because I just didn't feel like it since he broke his own rule knowingly.
