    Not exactly? It depends on the context. You don't just jump straight to rape accusations just because one person was drunk during the ordeal. If the person consents or has the capacity to give consent then you can't exactly fault that.

    In this context, I feel like she was too drunk to consent. You can see that in ch. 2, she is thinking smth along the lines of, “oh god I know I was drunk but how could I think of sleeping with him”, which probably means that she wasn’t in her right mind when she consented. Also, she wasn’t staggering along the wall in ch. 2, which signifies loss of motor control, which , according to https://www.colorado.edu/health/blog/drinking-and-sex#:~:text=No.,person%20is%20unable%20to%20consent. , means that, “ consent is not possible regardless of what the person is saying or doing.”

    Yes,i f someone is too drunk to give meaningful, informed consent, then sex with them can absolutely be considered rape. Consent isn’t valid if someone is incapacitated. That said, there can be grey areas depending on how intoxicated someone was and what the laws say in that jurisdiction. But the key principle is, if there’s any doubt about someone’s ability to consent, the safest and most respectful thing is not to proceed.
