Even if the uke can't say no, THAT DOESN'T MEAN THEY HAVE CONSENTED TO HAVE SEX BY DEFAULT. The absence of no does not mean yes, get that straight. Often times, when people are getting raped, they go into shock and cannot say anything, and that's not their fault. The rapist is at fault for raping them.
This reminds me of the Yes Means Yes laws.
