Retroactive Consent

Retroactive Consent is not a thing that's a thing. Without prior and continuous consent, it is sexual assault. Also, sleeping or unconscious people can not give consent.

    Forgot to make my point... Yaoi is really bad at blurring this line, but the entire genre is dubcon-fantasy, so if I was offended by fictional rape, I wouldn't still be reading it after so many years. :)

    Something i wonder though, is it still sexual assault if the opportunity for consent wasnt available but would of been given had it been? Like in this specific example he was asleep and unable to give consent. However if despite that, after the fact he says its fine and if he had been asked beforehand he would of also been onboard, is that still considered sexual assault?

    Are you serious? So using your logic, any girl who gets raped while shit-faced drunk and passed out at a party isnt being sexually assaulted, because if she was awake there would be a possibility for consent?

    You don't know if he would've been on board since he said yes to a girl. The only reason he responded that way to Akira is because this is yaoi and logic does not exist. In real life, this would be rape, so yes it is still considered sexual assault.

    You literally answered none of my questions. What im saying is if I, had a guy i was into who had sex with me while i was asleep and i am, will be, and was ok with it, (despite not being able to give consent beforehand) is it still sexual assault? Obviously a drunk girl at a party is not the same so dont respond to me as if the answer is black and white because it isnt.

    Ans: No. As long as he knows you'll be okay with it and your feelings are mutual. I've had sex with my boyfriend while asleep. If I go a couple weeks without sex, then I subconsciously have sex with him.

    First of all, I can see how I worded it in a way that's confusing. Second, that is the WILDEST thing I've ever heard. Is it... like sleepwalking or something? You only know the next morning it happened?

    This is why it never ok to have sex with an unconscious person, even if you think they will be ok with it...

    Scenario 1: A man and his wife go to a party, come home, and she's wasted. He has sex with her while she's unconscious because he thinks she won't mind. She wakes up halfway and thinks it's sexy and she's into it.

    Scenario 2: A different man and his wife go to a party, come home, and she's wasted. He has sex with her while she's unconscious because he thinks she won't mind. She wakes up halfway and FREAKS OUT. She cries, and says she feels violated, and how dare he do something so terrible...

    Both men did the exact same thing...

    Consent can never be assumed. It exists or it doesn't and it can't be granted retroactively.

    Having sex with someone who is incapable of giving consent is rape, even if they don't mind. That's why 17 year olds aren't allowed to have consensual sex with 30 year olds. They are below the legal age of consent. That is why it is illegal to have sex with someone who is intoxicated even if they want to. They are not in their right mind and are unable to give consent. It's why doctors can't have sex with their patients and why bosses can't have sex with their subordinates and why no one who is severely mentally handicapped can give consent at all.
    Even if the person in those situations gives consent, the power imbalance in the relationship removes it.

    We live in a society where girls have sex with people they aren't all that interested in just because they can't think of an easy way to say no. And that is something we need to change.

    Unless you gave actual consent before you were in a state where you could no longer consent then it technically is assault regardless of whether you’re okay with it or not (eg you’ve told your boyfriend beforehand that it’s okay to have sex with you even when you fall asleep)
