Ok so I reread and the uke still asked to have sex the second time when seme pushed him on the bed. Seme was doing what the uke asked and it caught the uke off guard. The seme was just being an an ass about it. He also asked the seme for sex the first time too. I'm pretty sure the uke was drunk so I don't know if that would be considered rape or not but where I'm from its not. As long as you give consent it's not necessary rape. Its just put judgement on the Semes sides

if somebody has sex with a person unable to give consent it is rape

It depends on the level of drunk. If you're tipsy and you can still count to 50 perfectly fine then your ok to give consent but if you get so drunk that you don't even remember what happens then no you're not good. Personally if this happened to me id just assume it was poor judgment but it's never happened to me and I like to think everyone is a good person bc I'm naive but the doc should have known better
