It’s just making excuses. It might not be there intention but their bias in even the way they asked the question to redirect the conversation. You don’t even need to question the uke’s actions if you’ve actually read the story. Any rational person wouldn’t condone the uke’s actions but would reasonable understand WHY he did it. The seme just is vindictive and annoyed by his HOSTAGE and wants to further show his POWER over him. Motivation and context means everything. But somehow they equate each other when the seme is seen as sympathetic, a violent mafia boss who kidnaps, tortures, likely kills people is the same as some random guy with bad luck and a worse sister..... sure.
