I don't think so. From the way she made it sound they never did anything but the only way she can prove that is the lack of children that they both did not have together. I think it's more so she can claim but you did not perform her marriage duties did you get hand the title back over to jemmy. It's really weird but back then weird stuff like this makes sense.
