TLDR R*pe and assault are not just physical crimes, the amount of physical violence is not the only thing that matters. In fact the psychological damage matters much more.
Edit: I wanted to add that it's incredibly heteronormative to require penile penetration as a condition of r*pe as that completely ignores the fact that sex does not always involve penile penetration. For example female r*pists often times are not brought to justice because they usually do not penetrate their victim, it's an incredibly horrible oversight.
