Because alcohol makes people’s state of mind unclear and make them bolder. Someone who didn’t want to have sex sober would suddenly want to when drunk.
If a person is just tipsy it’s fine because they are mostly still themselves. The way to check if one’s state of mind is clear enough to give proper consent is to ask repeatedly (if they want sex) without pressure. Something that I rarely see in yaoi. Though On & Off has a good scene in this regard : when the uke wants to have sex, the seme makes sure he can walk straight on a line before accepting.
The laws regarding alcohol and consent are different across the world : most western countries follow what I just said, but some only disregard the presence of consent if the alcohol is considerably high (if the person can’t move at all for example...). Some others countries don’t take alcohol into account at all.

Uh i just want to throw this in here but the uke didnt really reject the seme's kisses either and during the first sexual exposure they had I thoguht there was going to be adiscussion abt their feelings since the seme probably misunderstood the ukes consent to his kisses and stuff. I do understand your point of view. Akihisa was definitely scared shocked and stricken by that incident but this situation was kinda brushed off. I will say it was dub con for the stories sake. But in a normal situation that was basically rape. Because Yuu wasn't drunk. And akihisa didn't consent to the sex. He didn't even know that they were going to have sex!
lolol true but at tbh I think both of them are pretty much airheads- no discussion at all about dating or anything and Akihisa not even telling Yuu how he felt like when he kissed him to the point it became a natural thing. (even if it is under the pretense that he thought Yuu appreciates "Western culture" lol) Both of them lack common sense and I felt this could have been much better if they communicated with each other but judging from their verbal social skills or lack thereof it would quite a challenge lmao. Kinda sad how this manga would have been really wholesome and really enjoyable if it wasn’t for the rape (the uke was still drunk). I feel a bit bitter since almost no readers acknowledge it and the manga is basically in the “only fluff, no twists” category.
I understand that for a lot of people especially the younger one, rape can be an unfamiliar concept. But don’t just disregard the experience of victims just because you want to enjoy your manga in peace (“guilt-free”). I was assaulted several times by people who said that they wanted to be friends and I can tell you that this is not a nice feeling. I am pretty sure that people who gloss over the sexual assault / rape trope are those who didn’t experience it first hand ; realize that this is a privilege in a society where it is pretty common.
