Yes. “Letting something happen” =/= consent. Consent is consciously given, NEVER latently assumed. If he said he wanted to and then watched, it wouldn’t be sexual assault, but because he’s repeatedly said no and asked them to stop... standard definition of sexual harassment/assault.
