I have my critiques with this webtoon but it doesn't mean I don't like it. The protagonist is extremely problematic but I like him enough to want to see him grow. His past does not necessarily excuse his behavior, instead it gives an insight and to understand why he's made bad choices/ had only bad choices.
I can see why its not incest on a technicality. That alone isn't super convincing just because of no blood relation. However, you can strengthen the argument that it's not incest, with the fact that adopted male lead never felt like a family with his obsessive "older brother". Male lead does seem to express not feeling like family or I'm reading incorrectly.
Um Rape happens by physical force, coercion, abuse of authority, or against a person who is incapable of giving valid consent, such as one who is unconscious, incapacitated, has an intellectual disability, or is below the legal age of consent. Letting it happen and giving consent are 2 different things. However maybe you have a specific panel in which consent was given where there is rape.
