I mean, I can see why you would think that but technically it is. There are laws that dictate that sex while drunk is rape. However, I imagine that if both parties are drunk it is hard to argue in court which one is the victims you know? I think maybe they look into the situation and decide? Ok ok, but y'all discussing law semantics but like do we even know if any of them are "victims"? Like do we even believe that either of them was left with some sort of trauma and/or emotional distress? The court won't do wack if you can't argue that one of them suffered from the process.

So if this somehow ended in court they'd most likely drop it since they can't even be sure what damages need to be paid for (through various means)

Tbh I don't like people on both extremes. A drunk kiss isn't a green light, but also a kiss can be pretty terrible if you're in a position where you can't consent. Overall it's gonna be glossed over most likely in future chapters so all the arguing is a bit pointless
