Not that this plot is essentially going that route but if one person is clearly drunker than the other which is very much the case here and is incoherent or making decisions centered from their drunkenness, that person isn't of sound mind to consent to sex. Sure their actions can say otherwise but is murky area that usually allows date rape rapists to operate in real life as alcohol is number one drug used to facilitate lowering one's inhibitions and reaction time.
