I pretty much use the standard definition for my country...unlawful sexual activity and usually sexual intercourse carried out forcibly or under threat of injury against a person's will or with a person who is beneath a certain age or incapable of valid consent ;unlawful sexual intercourse or any other sexual penetration of the vagina, anus, or mouth of another person, with or without force, by a sex organ, other body part, or foreign object, without the consent of the victim. Under this definition if a guy persists in asking for sex and the girl gives in to shut him up that is not rape, it isn't force either in my opinion, but it is harassment.

It’s honestly a very very tricky and grey situation because albeit the Omega was unable to give proper consent as they were not in the right mindset, similarly to those when intoxicated, he still did initiate everythinf and “pounced” on the alpha. That’s why everyone suggests for those to not have sex while under the influence, because you don’t really know if you wanted it then or not and people always go back on their word and blame it on the other person as rape, even if there is some validity to it. The intention of the omega in this case would be more important than his actions (it's not for all cases).
So I would say he did not rape the alpha ON PURPOSE, which I highly doubt is a crime in ABO worlds.
