I’ve never heard of the last scenario. Usually if one party is intoxicated and the other isn’t, that’s considered ràpe if the intoxicated party sobers up and doesn’t remember giving consent. I don’t know why two drunk parties with given consent would cause the *male* party specifically to be guilty of rape. Unless the other party consented to it with a clear head, it’s best to avoid it altogether.
And yes, sometimes consent is given through intimidation (which is sexual and emotional manipulation), which does not count as real consent. But we can agree that a “no” absolutely means a “no”.
That’s the thing—if it’s a stranger/someone you don’t know very well, STOP. And then you can always ask for consent again. I say ‘no’ or ‘stop’ sometimes in the heat of the moment too when I get embarrassed, but please be respectful and stop when it’s said aloud or even hinted at that they’re not into it. It’s so easy to ask for confirmation. When I say no, my partner can and usually does just ask again if it’s okay to continue. It’s really just that simple.
