Its a gray area (legally speaking) hence not always referred to as rape or sexual assault. So as a decent human being we shouldnt take advantage of gray areas, the best course of action here is dont have sex with drunk people.
I agree with the first part, but not the second. Dead drunk i.e. on the verge of passing out, can barely walk, blackout, I agree. Don't have sex with that person (the uke), but you can't always hold an intelligent conversation when you're just normal drunk and a lot of girls/guys like their one night stands just like that. In all fairness there are obvious signs like how s/he's seducing you all night and invites you back to her/is place or yours. Just make sure this is something they initiated and that you're not manipulating the situation to end up having sex with them. Also of course if at anytime they say "no" the answer is no.

Drunk one night stands can be legit and purely consensual. Words of caution tho, the person "receiving" the signals may also be interpreting things as they want without being aware of it which is the defense of a lot of rapists.
