The thing is, even if brainwashed, you're still in control of your actions since the brainwashing is suggesting you do this and that, but in the end you have to be the one to actually do it. It's like a strong coercion while still being the one to hit the button. So if he didn't feel even a little that way, it wouldn't be able to be put into motion. This is how I'm feeling the ability is used, plus I'm not sure if the MC knows it's what's happening to the brother-in-law

So yes, the Sword King is being brainwashed.
In a few chapters ahead, Jihan, our MC will attract even more attention because of how strong his is with his rapid growing and the formation of a nurturing guild, and Japan will get interested in acquiring him. More precisely, the Japan's Goddess is the one interested in grabbing him for Japan because she wants Japan to be the number one league and etc.
So she will hatch a plan to capture Jihan to her side. And in that will discover her true powers, how she captured the Sword King. On her own words it wasn't easy to capture the Sword King, she spent months to have enough hold to pull him out of the house. Apparently, after his wife's death he decided the best way to get over that was to play around with women, but before none of them had any sway of him and Se-ha (his daughter) was the most important one and he never let any of his escapades get in her way. And because of his love for his daughter was so strong that it took so long for the Japanese woman to have control over him. That's why Se-ha was left behind, because his love for his daughter was one of the things that weakened the Japanese woman's power over the Sword King. The nature of the power the woman used on the Sword King completely altered his personality, because since "Obedience" didn't work on him, she had to use "Obsession", which completely turned him around for her. That's why he acts out of character and says things like "I have no daughter", because she said so.
When the Japanese woman comes to try to enchant Jihan and fails, he exposes her to the world and also shows that the Sword King was enchanted by her. And he decides to try and help his brother-in-law just because of Se-ha.
