The shitty emperor suggests the divorce. His plan is to make Trashta as Empress so she can give the baby crown prince title (ONLY THE empress's kid can inherit). Then he'll demote Rashta and make the FL empress again. Yes, he's an asshole.
Of course, instead of being normal and approaching his empress/wife lovingly and suggesting a plan for an heir and seeing what she thinks, he resents that she's too "cool" and he wants to punish her a bit.

When she finally is divorced and is planning to remarry Heinly, he plots to keep her in the kingdom but she escapes.
